HINDI ASSISTANTS
(6) (i) Fifty
percent of the vacancies in the Assistant Grade shall be filled by promotion of
Upper Division Clerks who have
rendered not less than five years service in the Grade or ten years combined
service in the grade of Lower Division Clerks
and Upper Division Clerks with at least
three years' continuous service in the Grade of Upper Division Clerks on
the basis of basis of seniority -cum- fitness , and fifty percent
of the vacancies shall be filled by direct recruitment on the basis of
competitive examination held for
the purpose by the Staff Selection Commission.

(ii) Vacancies in the Grade of Hindi Translator Grade I shall be filled
by promotion by selection of suitable Hindi Assistant or Translator grade II who
has rendered not less than 5 years ' continuous service in that grade
failing which, by deputation or
transfer of suitable persons engaged in translation work in other Ministries or
Departments possessing Master's Degree in in Hindi or in English as a subject at
degree level; failing which, by direct recruitment .
(Period of deputation ordinarily not exceeding 3 years.)

(iii)Vacancies in the Grade of Hindi Translator or Grade II shall be filled by deputation /transfer from Upper Division Clerks/ Lower Division Clerks, with 5 years service in the Grade who posses degree of a recognized with Hindi and English as elective subject, failing which, by direct recruitment.
(Period of deputation ordinarily not exceeding 3 years.)
(iv)
Vacancies in the Grade of Hindi Assistant shall be filled by promotion of
suitable Upper Division Clerks /Lower Division Clerks who have rendered not less
than 5 years service in which by transfer or deputation from the other
Ministries / Departments of the
Government.

(1) (i) There shall be four grades of Stenographers the Ministry
classified as follows:-
(A)
Principal Private Secretary
Central civil Q service Group '
A' Gazeett Ministerial.
(B) Private Secretary
Central Civil Service Group 'B' Gazetteed , Ministerial.
(C)
Personal Assistant
Central Civil Service Group 'B' Non-Gazetted, Ministerial.
(D)
Stenographer
Central Civil Service Group 'C' Non-Gazetted, Ministerial. :
5 (1) (ii)
Omitted.
(iii) All posts of First Personal Assistant and Assistant Private Secretary to the Minister and First Personal Private Secretary. All posts of Second Personal Assistant to the Minister and the Deputy Minister shall form part of the Grade of Personal Assistant.
(iv)
All deputy posts in the grade may be
declared by the Ministry to be excluded from the service, if it is necessary in
public interest for the time being to fill such a post by a person other than a
Officer of the appropriate grade of the service and shall remain excluded from
the service so long as such declaration remains in force.
(v)
If, and for so long as one or more
posts of First Personal Assistant to the Minister or Deputy Minister or of
Assistant Private Secretary to the Minister are filled by the appointment of
persons other than Stenographer of the Ministry, or by officers in the grade of
personal Assistant or in the grade of Stenographer of the Ministry, who are not
approved for promotion to the grade of Private Secretary or if approved for
promotion to that grade, are due for such promotion, a corresponding number of
posts in the grade of Personal
Assistant shall be temporarily upgraded to the grade of Private Secretary
.
Provided that the post of Assistant Private Secretary to the Minister when held by an officer in the grade of Private Secretary, the post shall be treated as a temporary addition to that grade for so long as it is so held by that Officer.
(vi)
Omitted.
(vii)
If, and for so long as one or more
posts of second personal Assistant to the Minister or Deputy Minister are filled
by appointment of persons other than Stenographers of the Ministry who are not
approved for promotion to the grade of Personal Assistant , or if approved for
to the grade, are not due for such promotion , a corresponding number of posts
in the grade of such Stenographers in the Ministry shall be temporarily
upgraded to the grade of
Personal Assistant or by persons in the grade of Stenographer in the Ministry
shall be temporarily upgraded to the grade of Personal Assistant.
(2)
(i)
& (ii) Omitted.
(5) (3) (a) Appointment to the grade of Principal Private Secretary shall be made by promotion, by selection, from the Officers in the grade of Private Secretary of the Ministry who have rendered not less than eight years of approved service in that grade.
Provided that if any person who is in the grade of Private Secretary in the Ministry is considered for promotion to the grade of Principal Private Secretary, all persons senior to him in that grade shall also be considered provided they are not short of requisite qualifying /eligibility service by more than one years and have successfully completed their probation period, if prescribed.
The Departmental Promotion Commitee (for Group A Posts upto the level of
Rs -3000-4500 ) shall consist of the following :-
1.
Chairman /Member , Union Public Service Commission -Chairman
2.
Joint Secretary, Ministry of Parliamentary Affairs-Member.
(3) (b), Appointment to the grade of Private Secretary shall be made on the basis of merit with due regard to seniority from amongst persons in the grade of Personal Assistant and who have rendered not less than eight years approved service in that grade.
Provided
that if any person who is in the grade of Personal Assistant of the Ministry is
considered for promotion to the grade of Private Secretary , all persons senior to him in that grade shall
also be considered provided they are not short of requisite qualifying
/eligibility service by more than one year and have successfully completed their
probation period, if prescribed.
(3) (c) Appointment to the grade of personal Assistant shall be made by promotion from amongst the persons in the grade of Stenographers of the Ministry who have rendered not less than 5 years approved service in that grade on the unfit and on the basis of competition examination in the ratio of 1:1.
(3) (d) Appointment to the grade of Stenographer shall be made on the basis of competition examination conducted by the Staff Selection Commission limited to the members of the Clerical as determined by the Central Government in the Department of Personnel and Training in the Ministry of Personnel, Public grievances and pension:
Provided that to the extent a sufficient number of qualified candidates are not available for appointment on the result of such competitive examination, the vacancies may be filled, provisionally or on regular basis, in such a manner as be determined by the Central Government in the Ministry of Parliamentary Affairs.

344- In
exercise of the powers conferred by the proviso to article 309 of the
constitution and in suppression of the Department of Parliamentary Affairs
(Recruitment and Conditions of Service) Rules 1963, in so far it relates to the
post of Upper Division Clerk Grade I except
as respects things done or omitted to have been
done before such suppression, the President hereby makes the following
rules regulating the method of recruitment to the post of Upper Division Clerk
grade in the Ministry of Parliamentary Affairs, namely :-
1.
Short title and commencement-
(1) These rules may be called the Ministry of Parliamentary Affairs, Upper
Division Clerk, Recruitment Rules, 2003.
(2) They shall come into force on the date of their publication in the
Official Gazette.
2.
Number of posts, classification and scale of pay, -The
number of the said post, its Classification and the scale of pay attached
thereto shall be as specified in columns (2) to (4) of the schedule annexed
hereto.
3.
Methods of recruitment, age limit and qualification, etc, _ The method of recruitment, age limit, qualifications and other matters
relating to the said post shall be as specified in columns (5) to (14) of the
said schedule.
4.
Disqualification.
_ No person, _
(a) who
has entered into or contracted a marriage with a person having a spouse living ;
or
(b) who,
having a spouse living, has entered into or contracted a marriage with any
person, Shall be eligible for appointment to the said post:
Provided
that the Central Government may, if satisfied that such marriage and that is
permissible under the personal law applicable to such person and the other party
to marrige and that there are other
grounds for so doing, exempt any person from the operation of this rule.
5.
Power to relax._ Where
the Central Government is of the opinion that is necessary or expedient so to do
so , it may, by order, for reason to be recorded in writing and whiever
necessary , as may be prescribed from time to time, relax any of the provision
of these rules with respect to any class or category of persons.
6.
Saving. - Nothing in these rules shall affects
reservations, relaxation of age limit, and other concessions required to be
provided for the Scheduled Caste, Schedule Tribes, Other Backgrounds Classes, Ex
servicemen and Other Special Category of persons, in accordance with the Orders
issued by Central Government from time to time in this regard.

Departmental Officers in the
feeder category who are in the direct line of promotion shall not be
eligible for consideration for appointment on deputation. Similarly,
deputations shall not be eligible for consideration for appointment by
promotion. (Period
of deputation including period of deputation in another ex-cadre
post held immediately preceding this appointment in the same or
some other organization
/department of the Central Government shall ordinarily not to exceed three
years. The maximum age limit for appointment by deputation shall be not
exceeding 56 years as on the closing date of receipt of applications). |

(8) (a) Ten Percent of the vacancies in the grade of Lower Division Clerks shall be filled by appointment by promotion of group 'D' employees (borne on regular establishment) of the Ministry in the following manner , namely :-
(i) Five percent of the vacancies may be filled on the basis of qualifying examination held for the purpose by the Staff Selection Commission from amongst Group 'D' employees who have rendered at the crucial date not less than five years regular service in the grade, posses at least Matriculation or equivalent qualification and are with in 45 years of age ( 50 years in the case of the Scheduled castes and the scheduled tribes).
(ii) Five percent of the vacancies may be filled on the basis of seniority, subject to the rejection of the unfit , from amongst those Group 'D' employees of the Department who have rendered not less than 5 years Matriculation or an equivalent examination of a recognized Board or University;
Provided that to the extend to which sufficient number of qualified candidates are not available for appointment on the result of such examination mentioned on clause (i) or for promotion as mentioned in caused (ii), the vacancies may be filled by direct recruitment on the result of a competitive examination held for the purpose by the Staff Selection Commission.
Provided further that if more of such employees than the number of vacancies available under clauses (1)
qualify at the said examination such excess employees shall be considered for filling the vacancies arising in
the subsequent years so that the employees qualifying at an earlier examination years so that the employees
qualifying at an qualify at a later examination.
(b) (Ninety percent of the vacancies in the grade of Lower Division Clerks or such higher percentage as may be determined by in accordance with the proviso to clause (a) shall be filled by director recruitment with the proviso to Clause (a) shall be filled by direct recruitment on the result of a competitive examination held for the purpose by the Staff Selection Commission.
Note : The persons appointed to the grade shall rank interse in the following manner, namely :-
I. Those appointed under clause (a) (i) of this sub-rule shall rank inter-se in the order in which their names are
arranged in a single list by the Staff Selection Commission on the basis of their seniority in the parent Group
D' post the employees holding post in a higher grade to rank senior to those in the lower grade.
II. Those appointed under clause (a) (ii) of this sub -rule shall rank inter-se in the order of their seniority in the lower grade the employees holding posts in a higher grade to rank senior to those in the lower grade.
III. The inter-se seniority of persons referred to in items (i) and (ii) shall be in the ratio of 1:1 that is to say, that the persons in these categories shall be arranged by taking alternately one person each from amongst the categories of persons specified in items (i) and (ii)
IV. Those appointed under clause (b) of this sub-rule shall rank inter-se in the order of merit in which they are placed at the competitive examination on the results of an earlier competitive examination being ranked senior to those of a later examination.
V. The inter-se seniority of persons referred to in items (i), (ii) and (iv) shall be regulalated according to the quotas fixed for each of the Department starting with one person referred to in item (i) followed by 9 from item (iv) and one person from item (ii) followed by 9 from item (iv) and so on.
VI The seniority of persons qualifying or appointment under clause (a) (i) of this sub-rule in excess of the number of vacancies available for that year and who are to be adjusted against the vacancies in subsequent year under clause (b) of this sub-rule shall also be regulated in the manner provided in item (v); provided that seniority of persons recruited on the result of the competitive examination held under clause (b) in whose cases offers of appointment are revised after being cancellation and those appointed under the proviso to clause(b) shall such as may be determined by he Department.
(c) Not withstanding any thing contained in clause (a) or clause (b), the appointing authority contained in clause (a) or clause,(b), the appointing authority may fill not more than 5% of the vacancies in the grade of Lower Division clerk arising in a year, by appointment of a son or daughter or spouse or brother or sister a Government servants who dies during the period of his service and the person so appointed shall be ranked juniors to the persons who are recruited on the basis of competitive examination held in that years.
STAFF
CAR DRIVERS
(9) A
vacancies in staff car Driver Grade I shall be filled by promotion from Staff
car Driver Grade-II who have put in six years of regular service on seniority
-cum--fitness basis , subject to passing of a trade test of appropriate
standards laid down in schedule III of this rules;
B Vacancies in Staff Car Driver Grade II shall be filled by promotion from Staff Car Driver in the Ordinary Grade who have put in nine years of regular service on seniority-cum-fitness basis and subject to passing of a Trade Test of appropriate standards laid down in Schedule III to these rules;
C.(i)Vacancies of Staff Car Driver in the Ordinary Grade shall be filled
by transfer from Dispatch Riders
and Group'D' employees of the Ministry - who have put in regular service of
(five years subject to the passing
of a Trade Test in driving as laid down in schedule III to these rules:
(ii)
Failing (i)
(a)
by deputation not exceeding three years;
(b)
by re-employment;
(c)
by transfer of ' Staff Car
Driver' in other Ministries or Departments.
Note:
The Armed Forces Personnel due to retries or who are to be transferred to
reserve with in a period of one year and having the requisite experience and
qualifications prescribed shall also be considered. Such persons would be given
disputation terms up to the date on which they are due for release from the
Armed Forces. There After enter they may be continued on re-employment.
(iii)
Failing (i) and (ii), by direct recruitment.
(10) (A) Vacancies in the grade of Addressographer shall be filled by promotion of Daftries and Jamadars with five years' service in order of seniority , subject to profienciey in handling addressograph machine.
Provided that if suitable departmental candidates are not available such vacancies may be filled by direct recruitment.

(10) Vacancies in the Grade of Gestetner operator shall be filled by promotion of Daftries or Jamadars with five years service in either or both the grade subject to proficiency in handling the Gestetner machine, provided that direct recruitment may be made when suitable departmented candidates are not available.

(10)(A) Vacancies in the grade of Addressograph shall be filled by promotion of Daftries and Jamadars with five years service in order of seniority, subject to proficiency in handling addressograph machine.
Provided that if suitable department candidates are not available such vacancies may be filled by direct recruitment.

11) Vacancies in the grade of Daftries and Jamadars shall be promotion of suitable peons in the ministry with five years' service in the grade.
12) 25% of the vacancies occurring in the grade of peon shall be filled by transfer of sweeper, farash and chowkidar serving in the Department who have put in a minimum of five years' service and who may not be possessing the qualifications prescribed for direct recruitment the post but in a minimum of five years' service direct recruitment to the post but who may possess elementary literacy and give proof of ability to read either English or Hindi or Regional language and the remaining 75% of the vacancies shall be filled through employment Exchange or by transfer of Group 'D ' servants serving in the other Departments of the Government of India or Government of a state.
Liability of a persons appointed as peons to undergo training as Home Guards:- Not withstanding anything continued in these rules shall undergo training as Home Guard for a period of three years.
Provided that the commander General, Home Guards, may having regard to the performance of and standard of tanning achieved by, any person during the training, for reasons to be recorded in writing, for reasons to be recorded in writing, reduce such period to two years.
(9) (D) vacancies in the Grade of Dispatch Rider shall be filled by transfer on the result of a test in driving designed to adjudge suitability for the post with reference to standards of competence consider essential in drivers of commercial Scooter or Autorickshaw, from amongst the regular class iv employees of the Department who possess the qualification specified in column against S.No.6-d in Schedule III, failing which by director recruitment.
