PRESS RELEASE

 

 

            The Monsoon Session of Parliament shall commence on Monday, the 21st July, 2003 and will conclude on Friday, the 22nd August, 2003 with a total of 22 sittings.

 

Prime Minister will make a statement regarding his recent visits to Germany, St. Petersburg, Evian and China in Lok Sabha on Monday, the 21st July, 2003 and in Rajya Sabha on Tuesday, the 22nd July, 2003.  During the Session, there will also be discussion on the Motion regarding progress of implementation of Part IX and IXA of the Constitution (dealing with Panchayats and Municipalities as institutions of self Government) during the last en years and discussion on the Science & Technology Policy – 2003.  Apart from the Government Legislative Business, the Financial Business relating to the Supplementary Demands for Grants (General & Railways) will also be taken up for discussion and voting.

 

To finalize the Government Business for the Monsoon Session, Hon'ble Minister of Health and Family Welfare and Parliamentary Affairs held a meeting with Secretaries/Senior Officers of concerned Ministries on 14.7.2003 in which various items of Business were categorized into three categories depending upon their readiness, importance and priority.

 

The Bills pending in the two Houses which are likely to be taken for consideration and passing during the Session are in Annexure-I and Annexure-II.

 

The new Bills proposed to be introduced in the Monsoon Session of the Parliament are in Annexure-III.

 

Annexure- I

PENDING BILLS IN LOK SABHA

Reform of electoral  laws relating to donation to political parties, election expenses, state funding of elections and time allotted on electronic media to the political parties etc.

The Representation of the People (Amendment) Bill, 2003 as passed by Rajya Sabha.

 

Introducing open ballot system in place of existing secret ballot system in elections to the Rajya Sabha and doing away with the requirement of residence of a particular State for contesting election to Rajya Sabha from the State.

The Sick Industrial Companies (Special Provisions) Repeal Bill, 2001.

The Bill seeks facilitating/expediting revival/rehabilitation of sick companies and protection of workers' interests and where necessary, winding up of Companies.

4.

The Repatriation of Prisoners Bill, Bill, 2002.

 

To seek repatriation of convicted foreign offenders from Inda to the countries of their origin and repatriation of Indian convicted offenders from other countries.

5.

The Constitution (Ninety fourth Amendment) Bill, 2002

Setting up of a National Commission for Scheduled Tribes by bifurcating the existing National Commission for Scheduled Castes and Scheduled Tribes.

The Foreigners (Amendment) Bill, 2003 as passed by Rajya Sabha.

To amend the Foreigners Act to enhance the penalty from the existing five years' imprisonment to eight years' imprisonment.

7.

The Major Port Trusts (Amendment) Bill, 2001.

 

To enable Government to vest undertaking of Major Ports in successor companies (formed under the Companies Act), related matters and powers to remove difficulties.

8.

The Petroleum Regulatory Board Bill, 2002

 

Setting up of a Petroleum Regulatory Board to oversee and regulate the downstream petroleum sector subsequent to dismantling of Administered pricing Mechanism w.e.f. 1.4.2002.

9.

The Lokpal Bill, 2001

 

To provide for the establishment of the institution of Lokpal to inquire into allegations of corruption against public functionaries and for matters connected therewith.

 

Annexure- II

PENDING BILLS IN RAJYA SABHA

 

1.

The Airports Authority of India (Amendment) Bill, 2003 as passed by Lok Sabha.

 

To lease out the levy of fees, eviction of unauthorized occupants, Establishment of Airport Appellate Tribunal etc.

2.

The Fiscal Responsibility and Budget Management Bill, 2003 as passed by Lok Sabha.

 

The Bill seeks to strengthen fiscal management.

3.

The Central Vigilance Commission Bill, 2003 as passed by Lok Sabha

To provide for the constitution of a Central Vigilance Commission to inquire or cause inquiries to be conducted into offences alleged to have been committed under the Prevention of Corruption Act, 1988 by certain categories of Public Servants of the Central Government Corporations established by or under any Central Act, Govt. Companies, Societies and Local authorities owned or controlled by the Central Govt. and for the matters connected therewith or incidental thereto.

The Indian Council of World Affairs (Amendment) Bill, 2003 as passed by Lok Sabha.

 

To amend certain provisions of the Indian Council of World Affairs Act, 2001.

5.

The Merchant Shipping (Amendment) Bill, 2003.

To incorporate the provisions of IMO Convention, namely, MARPOL – accession IV & V.

 

6.

The Marriage Laws (Amendment) Bill, 2003

To amend the Special Marriage Act, 1954 and the Hindu Marriage Act, 1955 to provide that a petition for relief under the provisions of these Acts may be presented by the aggrieved wife to the District Court within the local limits of whose jurisdiction she may be residing and also to provide that the parties to a matrimonial suit could prefer appeal within 90 days instead of 30 days.

The Foreign Trade (Development and Regulation) Amendment Bill, 2001

 

To incorporate the provision regarding Imposition of Quarantine Restrictions on Safeguard grounds.

8.

The Companies (Amendment) Bill, 2003.

 

To amend Companies Act to implement the Recommendations made by Naresh Chandra Committee and to include the major remaining clauses of the Companies (Amendment) Bill, 1997 which was withdrawn on 7.5.2003.

The Factories (Amendment) Bill, 2003

To provide flexibility in the matter of employment of women during night.

The Juvenile Justice (Care and Protection of Children Amendment) Bill, 2003.

 

To amend sections 32, 33, 56, 57 and 59 of the Juvenile Justice (Care and Protection of Children Amendment) Act, 2000, as per the observation of the Hon'ble High Court.

To set up National Statistical Commission to monitor the nationwide strategies on core statistics and to function as apex authority on statistical coordination.

To implement, inter-alia, the proposal of demutualization of stock exchange of the Govt. and enhancing penal provisions to protect investor's interests.

To provide for a long term and stable policy framework for Special Economic Zones.

The Taxation Laws (Amendment) Bill, 2003.

 

Amendments to be made in the Finance Act, 2003 and Income Tax Act, 1961.

To regulate the employment and conditions of service of unorganized sector workers and provide for their safety, social security, health and welfare.

To amend certain provisions of the Electricity Act, 2003 as per assurance of the Minister of Power in Rajya Sabha at the time of consideration and passing of this Bill.

The Banking Regulation (Second Amendment) Bill, 2003.

 

To provide more operational flexibility to Reserve Bank of India in banking supervision and to tighten supervision on cooperative Banks.

The National Bank for Agriculture and Rural Development (Amendment) Bill, 2003.

 

To facilitate NABARD to refinance the District Central Cooperative Banks (DCCB).

The Chartered Accountants, the Cost and Works Accountants and the Companies Secretaries (Amendment) Bill, 2003.

 

A Bill to update the existing Acts.

The Right to Free and Compulsory Education Bill, 2003.

 

The Parliament has passed the Constitution (86th Amendment) Act, 2002 to make Elementary Education a Fundamental Right for children in the age group of 6-14 years.  It is proposed to bring in a follow-up legislation with detailed mechanism to implement the above act.

The Christian Adoption Bill, 2003.

 

To enable adoption by Christians or persons married under Christian Marriage Act.
